Successfully defended before the National Board of Appeals the #SWZ requirement for certification of the subject of the contract by the US administration – despite the device having all the qualifications and approvals of the EU.
Attorney Jacek Liput represented the contracting authority. The appellant demanded the deletion of the requirement for U.S. certification.
The Chamber dismissed the appeal in its entirety, extensively quoting our arguments in the oral statement of reasons.
The above requirement of the SWZ, according to our arguments, was found to be objective and non-discriminatory, based on the actual need of the contracting authority. And also proportionate, and therefore ultimately correct and possible for the contracting authority to impose.
The arguments for the objectivity of the certification requirement were based on, among other things, cyber security.
