The Polish Office for Personal Data Protection will investigate a complaint about OpenAI

The Polish Office for Personal Data Protection (UODO) announced on 20.09.2023 that it is investigating a complaint about ChatGPT’s data processing. We filed the complaint on behalf of Łukasz Olejnik against OpenAI. We informed about the filing of the complaint and its contents here

The President of the Office, Jan Nowak, indicated in the announcement that UODO will ask OpenAI to answer a number of questions in order to thoroughly conduct an administrative investigation. The subject of the investigation is expected to be, among other things, whether OpenAI, in developing and making ChatGPT available, acted in accordance with the fundamental principle of privacy by design.

Jakub Groszkowski, Deputy President of UODO, points out that the development of new technologies must respect the rights of individuals under, among other things, GDPR. The task of the European Data Protection Authorities is to protect EU citizens from the negative effects of information processing technologies.
