Pandemic restrictions vs. legal compliance.

Despite the fact that more than a year has passed since the beginning of the pandemic, and a vaccination system has been in place for many weeks, the situation regarding the spread of the Covid 19 virus is still of great concern. Increases in the incidence of the disease are increasing, and the number of deaths is rising. It is safe to say that the third wave of the pandemic is now underway.
This is directly linked to the imposition of new restrictions and bans.

RP.pl editor Agata Lukasiewicz wonders in an article what can be done to make pandemic bans legal?

The most controversial of the restrictions is the movement ban. If the government now intends to impose a ban on movement, it cannot do so by decree. This is because such a ban can only be imposed: during a state of emergency and by law.
– I do not see any other possibility than declaring a state of emergency,” adds Maciej Gawronski of Gawronski & Partners law firm.
