The Public Procurement Office has published guidance to help interpret key areas of procurement, such as the preparation of needs and requirements analyses, new modes of procurement, or the conditions that must be met by the description of needs and requirements prepared when using certain modes of procurement.
In the absence of case law on the subject, the guidance definitely makes it easier to understand and consequently apply the new regulations.
“Needs and requirements analysis is a novelty in public procurement law, so it is good that the Public Procurement Office has issued guidance for ordering parties,” according to Jacek Liput, legal counsel, counsel at Gawronski & Partners Law Firm.
